to enter the contest. Three lucky winners will be guest participants and drive a Ferrari F430 at HIGH SPEED on a closed racecourse in PA on September 10, 2010 $0.99 /msg. will be charged to your wireless bill or enter online at https://textcontest.robinhoodrally.com/enter. Up to 5 entries per person allowed. Msg&Data rates may apply. Participating US carriers: Verizon Wireless, AT&T, CBW, Alltel, Sprint, Nextel, Boost, Virgin. Must be 18 years or older to enter. Winners must possess a legal driver’s license and must sign a liability waiver prior to driving. A representative of the Robin Hood Rally will accompany winners at all times.  Contest starts on 7/15/2010 at 12:00noon EST and ends 9/01/2010 at 12noon EST. Winners will be called on 9/01/2010.   1. Duration
    • Contest starts on 7/15/2010 at 12:00noon EST and ends 9/01/2010 at 12noon EST. Winners will be called on 9/01/2010. ("the Contest Period") or any period as may be notified by the Organizer.
  2. Eligibility
    • The Contest is open to subscribers of prepaid and post-paid services of mobile phone operators providing Short Messaging System ("SMS") services in the USA. (hereinafter collectively referred to as "Contestants")
    • Employees and immediate family members of the Organizer, their advertising agencies, affiliates, subsidiaries, agencies and suppliers are not eligible to participate in the contest.
    • The Contestants must be 18 years of age or older years. Winners must possess a legal driver’s license and must sign a liability waiver prior to driving. A representative of the Robin Hood Rally will accompany winners at all times. The Contestants shall be permitted to participate in the Contest via the use of mobile phones or by online entries at https://textcontest.robinhoodrally.com/enter
    • By allowing their mobile phones to be used - bill payers acknowledge that they are bound by these Terms and Conditions. $0.99 /msg. will be charged to the contestants wireless bill Standard carrier rates apply & Msg Data Rates may also apply.
    • For the purposes herein, the term "bill payer" shall mean the individual, company or entity specified in the registration or subscription form.
  3. Contest Mechanics
    • Participating carriers in USA is Verizon Wireless, AT&T, CBW, Alltel, Sprint, Nextel, Boost, Virgin
    • To enter the Contestants must send in the entry by typing Ferrari(space)”your email” to 37706 (example: Ferrari joe@blue.com) during the Contest Period.
    • Contestants may send up to 5 entries during the Contest Period and more entries will be disqualified

  4. Contest Entries
    • The Contestant must ensure that their Contest entries are complete and accurate. Incomplete, illegible or late entries shall be disqualified.
    • The organizer reserves the right to reject any registration and/or entry to the event at its sole and absolute discretion without having to assign any reasons whatsoever.
    • The Contestant can send in up to 5 entries as they wish.
  5. Charges
    • The Contestant will be charged $0.99 per entry by the Contestant's mobile phone network operator. Msg data rates may apply.
  6. Judging
    • The Judge's decision is final and binding. No correspondence shall be entertained.
  7. Notification of Contest Winners
    • The three Contest winners will be notified by telephone. The organizer reserves the right to use any other method or medium it deems fit at its sole and absolute discretion for the purpose of announcing the Contest winner.
    • Contest winners might be required to ID at the request/notification from the organizer.
    • Winner will be called on September 1, 2010.
    • Participants will be must be eligible to win.
    • The organizer reserves the right to forfeit prizes for any Contest winner who does not provide the required details upon receiving the request/notification.
    • The organizer reserves the right to appoint a third party to conduct the verification of Contest winners and Contestants agree that the organizer may provide all necessary information of Contest winners to such third party to facilitate such service.
  8. Prizes
    • The contest winners will be guest participants and drive a Ferrari F430 at HIGH SPEED on a closed racecourse in PA on September 10, 2010
    • Each winner will be responsible for their own travel and accommodations to and during the event.
    • The organizer reserves the right to request legal proof of age and drivers license.
    • Must be 18 years or older to win.
    • Winners must possess a legal driver’s license and must sign a liability waiver prior to driving.
    • A representative of the Robin Hood Rally will accompany winners at all times. 
    • The organizer makes no warranties or representations whatsoever with respect to the prize and shall not be responsible nor liable for any problems and/or damage there to or arising there from.

  9. Proof of Receipt
    • Proof of SMS sent by a Contestant does not denote proof that the SMS was received by the organizer.
  10. Publicity
    • The organizer reserves the right, at its sole and absolute discretion, to use the nicknames, names, photographs, voice or video recordings and entries of the Contest winner(s) and/or representatives without first obtaining any consent nor making any payment whatsoever to the Contest winner(s) and/or representatives for publicity, advertising, trade or promotion purposes in any media.
  11. Adherence to Contest Terms & Conditions
    • In addition to these Terms and Conditions, instructions and methods of participating in the Contest, as set out on http://textcontest.robinhoodrally.com/ or otherwise, shall also bind all Contestants and their participation in the Contest.
    • In the event of any conflict between these Terms and Conditions and any terms contained in any promotional material for this Contest, the terms contained herein shall apply.
    • Failure to comply with the rules, regulations, instructions or methods will result in the Contestants being disqualified.
    • By participating in this Contest, the Contestant is taken to have read and agreed to the terms and conditions herein and shall adhere to all and/or any decisions made by the Organizer.
  12. Variation to the Terms & Conditions
    • The organizer reserves the right to change, amend, delete or add to these Contest Terms and Conditions without prior notice at any time and the Contestants shall be bound to such changes.
  13. Liability
    • The organizer will not be responsible or liable for:
      • Any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending a SMS as a result of any network, communication or system error, interruption and/or failure experienced by The participating mobile phone operators and/or by the organizer and/or resulting from participation or the downloading of any materials in the Contest. In the event of such error, interruption and/or failure, the organizer shall not be responsible or liable for any failure by any Contestant to participate in the Contest at any time.
      • Any problem, damage or loss of whatsoever nature to any Contestant, or their authorized representatives resulting from their participation in the Contest.
      • Any error (including error in notification of Contest winners), omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.
    • The Contest is provided on an "as is where is available" basis. The Organizer will not be responsible and will not be liable if any entry is lost, late or undelivered due to any reason other than the sole negligence of the Organizer. Proof of delivery of entries is not proof that the entries were duly received.
    • The laws of the State of New York, US shall govern this Agreement. All disputes arising hereunder shall be resolved by arbitration in New York City, New York, in accordance with the applicable rules of the American Arbitration Association before a panel of three (3) arbitrators, one appointed by Contestant, one appointed by MCG, and the third appointed by mutual agreement of the first two arbitrators. The arbitration will be conducted in English. The decision or award of a majority of the arbitrators shall be final and binding. Any arbitration award may be entered as a judgment or order in any court of competent jurisdiction. Any third party claims, where the applicable indemnity would apply shall be subject to the means of dispute resolution to which the indemnifying party is subject or chooses, provided that in the event of the latter, the indemnifying party first consults the indemnified party as to its preference and that the applicable state and federal courts of the State of New York have exclusive jurisdiction over any and all litigation.
    • The Organizer, its partners and its sponsors shall not be held responsible for any late, lost, incomplete or misdirected entries, computer system, phone line, electronic equipment, computer hardware, software and program malfunctions or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature or for problems in downloading SMS entries or for any other technical problems related to SMS entries.
    • The Organizer its partners and its sponsors are not responsible for any incorrect or inaccurate entry information, whether caused by its subscribers or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the entries in the Contest.
  14. Disqualification
    • The organizer reserves the right at its sole discretion to disqualify any individual that it determines to be tampering with the entry process or the operation of the Contest, to be acting in breach or potential breach of these Contest Terms and Conditions and/or the organizer's Website Terms of Use and Notices. No correspondence shall be entertained.
  15. Suspension
    • The organizer further reserves the right to cancel, modify, suspend or delay the Contest in the event of unforeseen circumstances beyond its reasonable control
